Stashcook: Meal Planner & Recipe Keeper

DMCA Policy

Background

At Stashcook, we recognise the importance of full legal compliance and the value of intellectual property rights. This policy outlines the commitment of Stashbox Ltd ("Stashbox", "Stashcook", "we", "us" or "our") to deal with copyright infringement seriously and to respond appropriately to valid notices under applicable law.

Stashcook provides tools that allow users to save, organise, and store recipes and related content for personal use. Content saved within Stashcook is stored at the direction of users. Stashcook does not review, curate, or publish user-stored content prior to it being saved.

When users save recipes using automated or AI-assisted tools, those tools extract and structure information from the source provided by the user, and the resulting Content is stored at the user's direction.

Takedown Notice

If the Digital Millennium Copyright Act (DMCA) applies, you may request the removal of allegedly infringing Content from our products and services by submitting a copyright notification to us.

Please ensure that your takedown notice complies with the DMCA. Guidance is available at: https://www.copyright.gov/dmca-directory/

In accordance with the Online Copyright Infringement Liability Limitation Act (17 U.S.C. § 512) ("DMCA"), a written notice (a "DMCA Notice") must include substantially the following:

You must ensure that any takedown notice you submit is truthful, not misleading, current, and complete.

If the DMCA does not apply to your claim, please submit a takedown request in accordance with your local laws. It is helpful if you provide at least the same level of detail as outlined above.

Our Response to Takedown Notices

Upon receipt of a complete and valid takedown notice, we will review the request and commence an investigation as appropriate. We may request additional information or clarification where necessary.

Where required under applicable law, we will act promptly to remove or disable access to the identified Content. In some cases, we may notify the user who stored the Content and provide them with information about the notice.

We do not tolerate the submission of false, misleading, automated, or abusive takedown notices.

Counter-Notification

If you believe that Content you have stored was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification in accordance with Section 512(g) of the DMCA.

A valid counter-notification must include:

If we receive a valid counter-notification, we may forward it to the original complainant. Unless we receive notice that the complainant has filed a court action seeking to restrain the allegedly infringing activity, we may restore access to the Content within a reasonable period, as permitted by law.

Takedown Process Outcomes

Possible outcomes of a takedown process under this Policy may include:

We may also remove Content for reasons unrelated to a takedown notice, including violations of our Terms of Service or other policies.

This Policy does not limit any rights we may have under applicable law or under any agreement with users or content providers.

Legal Notes

Nothing in this Policy is intended to limit any protections or safe harbours available to Stashcook under the DMCA, including Section 512, or other applicable laws. Where applicable, we may also rely on Section 230 of the Communications Decency Act (47 U.S.C. § 230).

Please note that knowingly submitting a materially false takedown notice may result in liability for damages (including costs and legal fees) under Section 512(f) of the DMCA.
