Background

At Stashcook, we recognise the importance of full legal compliance and the value of intellectual property rights. This policy outlines the commitment of Stashbox Ltd ("Stashbox" or "Stashcook" or "we", "us" or "our") to deal with any copyright infringement seriously.

Takedown Notice

If the Digital Millennium Copyright Act (DMCA) applies, you may have unauthorised copies of Content removed from our products and services by submitting a copyright notification to us.

Please ensure that your takedown notice complies with the DMCA. See guidance at https://www.copyright.gov/dmca-directory/

In accordance with the Online Copyright Infringement Liability Limitation Act of the DMCA (17 U.S.C. § 512) ("DMCA"), the written notice (the "DMCA Notice") must include substantially the following:

• Your physical or electronic signature.
• Identification of the copyrighted work you believe to have been infringed or, if the claim involves multiple works on the Software, a representative list of such works.
• Identification of the material you believe to be infringing in a sufficiently precise manner to allow us to locate that material.
• Where possible, provide a screenshot of the content.
• Adequate information by which we can contact you (including your name, postal address, telephone number, and, if available, email address).
• A statement that you have a good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the written notice is accurate.
• A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
• Provide details and proof. For example, if you are relying on a registered trademark, please provide the registration number and country of registration.

You must ensure that any takedown notice you submit to us is true, not misleading, current, and complete.

Once we receive a complete takedown notice, we will commence our investigation. We may ask you for more information or proof. We may set timeframes for you to respond to us. We will endeavour to reach our determination within 30 business days of receiving a complete takedown notice. We will act reasonably when implementing this Policy. We ask that you act reasonably too. We do not tolerate submission of false or misleading takedown notices, computer-generated takedown notices, or bulk/spam takedown notices. If the DMCA does not apply, please send us a takedown notice in accordance with your local laws. It would be helpful if you provide at least the same details in your takedown notice that are set out above for a DMCA takedown notice.

Takedown Process Outcomes

Possible outcomes of a takedown process under this Policy include:

• Permanent or temporary removal of some or all of the Content
• Removal of Content in specified jurisdictions
• Carrying out further investigations
• Referring the matter to law enforcement or lawyers

We do not have to provide you or anyone else with our reasons for our decision, but we may do so.

We may remove Content for other reasons, for example, for reasons not set out in the takedown notice.

This Policy does not limit our rights under any agreement we may have with a relevant person including you or a Content provider.

If you submit a takedown notice under this Policy, you agree to comply with the parts of this Policy that apply to you.

Where applicable, we may rely upon section 260 of the Communications Decency Act (47 U.S.C. § 230).

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective under the DMCA. Please be aware that if you knowingly materially misrepresent that material or activity on our products or services is infringing your copyright, you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.

Definitions

In this Policy, "Content" includes any content (such as text, photographs, logos, designs, and the like) that are provided by us via our products and services.

Our products and services include the Stashcook App and the Stashcook website (available at www.stashcook.com).
